DUI cases can be quite complex. Judges need to know about the intricacies
of searches, seizures, arrests, and a myriad of other criminal procedure
issues. Further, judges need to be able to rule upon issues with regard
to breathalyzers, blood/alcohol testing, and field sobriety tests as well
as understand the pharmacological effects of alcohol and drugs. This program
provides judges with state-of-the-art information on these subjects and
many others. After this course, participants will be able to analyze circumstances
providing legal bases for stops, searches, seizures, arrests and the admissibility
of testimonial or physical evidence; enhance a judge’s ability to
rule on evidentiary issues; apply the elements of a constitutionally valid
guilty plea; review field sobriety tests and other demonstrative evidence;
describe the principles of pharmacology to more effectively evaluate expert
testimony; and appraise and design effective sentences and sentencing
alternatives.
Qualifies as an elective in the Certificate in Judicial Development,
Administrative Law Adjudication Skills, Special Court Trial Skills and
Tribal Judicial Skills programs.
