American law is unique in its strong emphasis on solving important policy issues by the use of the rule of law. This course traces the philosophical underpinnings of American law, beginning with the Declaration of Independence, the U.S. Constitution, the Civil War and Reconstruction, the New Deal and the Warren Court up through the present day. Special emphasis is placed on the various judicial philosophies and historical events that have played a part in forming American law as it now exists. The application of judicial philosophy to future problems is discussed.

Qualifies as an elective in the Certificate in Judicial Development, AdministrativeLaw Adjudication Skills, General Jurisdiction Trial Skills, Special Court Trial Skills and Tribal Judicial Skills programs.
