This webinar will focus on the United States Supreme Court decisions impacting the exercise of peremptory challenges during jury selection in capital cases. The webinar will include a comprehensive discussion of Batson v. Kentucky and the cases that followed and expanded Batson. During the webinar judges will be introduced to the three-part test set out in Batson, applied in subsequent cases, and expanded in Miller-El v. Cockrell and Miller-El v. Dretke. In addition to helping judges master the substantive law, the webinar will address the procedural aspects of Batson, including application to recurring factual scenarios and practice pointers. Judges who engage fully in the webinar should be fully prepared to address Batson issues, assuring that the record fully documents challenges, responses, findings, and rulings essential to satisfying Batson’s constitutional mandates.
