Judges routinely make critical evidence rulings during trial with little opportunity for research or reflection and without sufficient amplification by counsel. Evidence Decision Trees (EDTs) provide a focused mechanism for judges to analyze complex evidentiary issues, while ruling both efficiently and fairly. During this session, judges will use EDTs in ruling on relevance, character, impeachment, hearsay, confrontation, and opinion objections.

During this course, you will learn to:
- The Two As EDT for separating authentication and admissibility issues;
- The FWP EDT for analyzing special relevance rules, character, and impeachment evidence;
- The OOCs IC TOMA EDT for differentiating between statements that are not hearsay, statements that fit within hearsay exemptions or exceptions, and statements that are hearsay;
- The Confrontation EDT for distinguishing between testimonial and non-testimonial statements and determining when the right to confrontation has been satisfied, waived, or forfeited; and
- The 3 Buckets EDT for evaluating the admission of opinion testimony and its underlying bases.
