Access to justice has increasingly become the focus in courts across the country.

This webcast will focus on the delicate balancing act of imposing pre-trial conditions on impaired drivers in traffic courts and the obstacles they often face in complying. This course will explore innovative and creative approaches to these cases while in the pre-trial stage and ways to avoid often crippling legal financial obligations and cost prohibitive conditions before final adjudication. This course will also address some of the practical challenges presented in imposing some conditions.

What will I learn?

During this course, you will learn to:

  • Recognize access to justice issues that can arise when imposing fee-for-service pre-trial conditions such as ignition interlock systems, SCRAM ankle monitors, daily drug/alcohol testing, etc.;
  • Determine the level of pre-trial monitoring necessary based on reliable need and risk assessment tools and identify low or no cost resources to ensure compliance with court ordered pre-trial conditions; and
  • Identify potential practical issues when imposing pre-trial conditions in traffic cases.

This webcast is presented through generous funding from the National Highway Traffic Safety Administration (NHTSA) in collaboration with The National Judicial College (NJC).
