With the increase in use of both illicit and prescription drugs in our communities, as well as a greater acceptance of the use of drugs, courts are facing a new type of impaired driver – the drug-impaired driver.

This change brings new challenges and new issues for trial judges. This session will provide an overview of some of the issues that arise in impaired driving cases.

What will I learn?

During this course, you will learn to:

  • Discuss current issues that arise in impaired driving cases;
  • Identify the different challenges presented in alcohol-impaired and drug-impaired driving cases; and
  • Discuss the role and importance per se statutes play in the trial of an impaired driving case.


Series Description:

To effectively and responsibly handle traffic cases, judges must not only weigh evidence and apply legal principles, but also provide meaningful access to the courts for all parties. This program will provide many of the basics for judges new to the bench to identify the issues that arise in handling traffic dockets and the tools to manage their courtroom with respect and with dignity.

Topics to be covered included: the Judge’s role in handling traffic cases, implicit bias and other access to justice issues in traffic cases, controlling the courtroom, impaired driving, toxicology essentials, commercial motor vehicles, and sentencing traffic offenders to reduce recidivism.
